Terms of Service

These Terms govern your access to and use of vexelkit ("the Service"), operated by Artyom Gorlovetskiy, an individual based in Georgia ("we", "us", "the operator"). By using the Service you agree to be bound by these Terms. If you don't agree, don't use the Service. Payments are processed by Dodo Payments, which acts as the Merchant of Record for all purchases.
1. The Service
vexelkit lets you generate brand-consistent illustrations and graphic assets via a hosted web app and REST API. The Service is provided "as is". We may add, change, or remove features at any time.
2. Your account
You must be at least 16 years old. You're responsible for keeping your sign-in credentials and API tokens secure. Any activity on your account is your responsibility. Notify us immediately if you suspect unauthorized access.
3. Acceptable use
Don't use the Service to generate content that infringes intellectual property, depicts minors in sexual contexts, harasses real people, produces deceptive media of identifiable individuals, or violates applicable law. We may remove content and suspend accounts that breach these rules, with or without prior notice.
4. Content ownership
You own the assets you generate, subject to the underlying image model's terms. On the Free tier, every generation is automatically published to our public catalog and made available for others to view and download — this is the explicit trade-off for free credits. Paid plans default to private; opting in to publish a generation grants others a perpetual, royalty-free, worldwide license to view and download that asset.
5. Payments, billing and refunds
All prices are shown in US dollars (USD). Our payment processor, Dodo Payments, acts as Merchant of Record: it collects payment and adds any applicable sales tax or VAT at checkout based on your location. Subscriptions renew automatically each billing period at the then-current price until cancelled. You can cancel any time from /billing; cancellation stops future charges and your plan stays active until the end of the period already paid for. Payments are for digital goods (credits and access) that are delivered immediately, so purchases are generally non-refundable and we do not offer money-back refunds at our own discretion. Instead, credits for generations that fail are returned to your in-app balance automatically, and unused credits never expire while your account is active. Required statutory refunds and clearly unintentional or duplicate charges are honoured and are processed by Dodo Payments in line with Dodo Payments' buyer terms. 6. Service availability
We aim for high availability but don't guarantee uninterrupted service. Maintenance windows are announced where possible. Upstream model outages may temporarily prevent generation.
6a. Asset URLs and privacy
Generated files are stored on a public-read CDN (assets.vexelkit.com). URLs include random UUIDs that are not guessable and are not indexed by search engines, but the underlying objects are technically accessible to anyone who has the URL. Treat URLs of private assets like passwords: do not paste them in public channels. For stronger privacy guarantees (signed URLs, encryption at rest), contact us — we can scope this on request.
7. Liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind, and our aggregate liability for any claim is limited to the amounts you paid us in the 12 months preceding the claim.
8. Termination
Either side may terminate at any time. We may suspend or terminate your account for breach of these Terms. On termination, your data is retained for 30 days, then deleted (catalog-published assets stay in the catalog under our license).
9. Changes to these Terms
We may update these Terms. Material changes are notified via email and in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
