Terms of Service

These Terms govern your access to and use of vexelkit ("the Service"), operated by Artyom Gorlovetskiy, an individual based in Georgia ("we", "us", "the operator"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service. Payments are processed by Dodo Payments, which acts as the Merchant of Record for all purchases.
1. The Service
vexelkit generates images from reference images and a text description, through a web app and an API, and offers ready-made image packs in a catalog. The Service is provided "as is" and "as available". Images are produced by AI: a result may be inaccurate, unexpected, or similar to other images. We don't promise that a result will fit a particular purpose. We may add, change or remove features at any time.
2. Your account
You must be at least 18 years old, or the age of legal majority where you live. One person may have one account. You're responsible for keeping your sign-in and your API keys secret, and for everything done through your account. Tell us at once if you suspect unauthorized access. The free generation is one per person; we may limit or close accounts created to obtain it repeatedly.
3. Acceptable use
Don't use the Service to create or upload content that is unlawful; that sexualizes minors; that shows sexual or intimate imagery of a real person without consent; that harasses or defames real people; that impersonates or deceptively depicts identifiable individuals; or that infringes someone else's copyright, trademark or other rights. Don't try to bypass safety checks, scrape or overload the Service, share API keys publicly, or resell raw access to the Service as a competing product. Prompts and reference images are checked automatically; we may block a request, remove content, and suspend or close accounts that break these rules, with or without notice.
4. Reference images you upload
You confirm that you own every reference image you upload or have the right to use it, including the rights of any person shown in it. You give us a limited licence to process your references only to produce your result. References uploaded on the site are deleted when the generation finishes; references uploaded through the API are deleted after 24 hours. You are responsible for any claim arising from your references and prompts.
5. Your results
As between you and us, the images you generate are yours, to the extent the law allows, and you may use them commercially. Please understand the limits: in some countries AI-generated images may not be protected by copyright; we don't guarantee that a result is unique or free of third-party rights; and similar or identical images can be produced for other users. Check a result before you rely on it, especially for trademarks, logos and the likeness of real people. Your generations are private to your account and are not published by us. Assets published under earlier versions of the Service remain available to others under the perpetual, royalty-free, worldwide licence to view and download that was granted at publication.
6. Catalog packs
Packs in the catalog are licensed, not sold. When you buy a pack you receive a non-exclusive, worldwide, perpetual licence to use its images in your own personal and commercial projects. You may not resell, sublicense or redistribute the files as they are or as part of another stock or asset collection, and you may not claim exclusive rights to them. A pack you bought stays available in your account. We may change prices or withdraw packs from sale.
7. Tokens, payments and refunds
All prices are shown in US dollars (USD). Our payment processor, Dodo Payments, acts as Merchant of Record: it collects payment and adds any applicable sales tax or VAT at checkout based on your location. Tokens are sold as one-time top-ups; there are no subscriptions and no recurring charges. Tokens are a prepaid balance for use only inside the Service: they have no cash value and can't be transferred, exchanged or withdrawn. The price of an action is shown in tokens before you confirm it; token prices may change for future actions. Top-ups are digital goods delivered immediately, so purchases are generally non-refundable. Tokens for generations that fail are returned to your balance automatically, and unused tokens never expire while your account is active. Refunds required by law and clearly unintentional or duplicate charges are honoured and processed by Dodo Payments. See our Refund Policy at /refunds.
8. API
API keys are personal. You are responsible for every request made with your keys and for the tokens they spend. Rate limits apply. We may throttle or revoke keys that harm the Service or break these Terms. You may build the API into your own products; you may not offer raw access to it as a standalone competing service without our written agreement.
9. Availability
We aim for high availability but don't guarantee uninterrupted service. Maintenance, outages of the providers we depend on, or safety checks may temporarily prevent or delay a generation.
10. Storage of your files
Full-size files are stored privately and delivered only through your account or your API key. Small preview images are served from a public content network. Keep your own copies of files you need: we don't guarantee permanent storage, and files of closed accounts are deleted.
11. Disclaimers and limits of liability
To the maximum extent permitted by law, the Service and all images are provided without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the greater of the amounts you paid us in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited by law.
12. Your responsibility for claims
If a third party makes a claim against us because of your prompts, your reference images, your use of results, or your breach of these Terms, you agree to cover our reasonable costs and losses from that claim.
13. Termination
You may stop using the Service at any time. We may suspend or close your account if you break these Terms. If we close your account without a breach on your side, we refund unused purchased tokens. After closure your data is kept for 30 days and then deleted; assets published under earlier versions stay in the catalog under the licence granted at publication.
14. Governing law
These Terms are governed by the laws of Georgia, and disputes are resolved by the courts of Tbilisi, Georgia. If you are a consumer, you keep the mandatory protections of the law of the country where you live.
15. Changes to these Terms
We may update these Terms. Material changes are announced by email and in the app at least 14 days before they take effect. Continued use after that date means you accept the new Terms.
